Current Bills in process and supported by NDEMSA:

HB 1108:  A bill concerning lessening conditions necessary to provide immunity from civil liability for persons using AEDs specifically for the licensed physician, the instructor providing training, and the person responsible for the site at which the AED is located.  Introduced by Porter.  Passed House 93-1.  Passed Senate 46-0.  Signed into law by the Governor.

HB 1110:  A bill to create a method of reimbursement for out of jurisdiction firefighting and to appropriate $100,000.  This bill has been referred to a sub-committee for amendment to include reimbursement for out of jurisdiction EMS.  Introduced by: Wald and amendments offered by Wald.  Passed House 92-1.  Reported back from Senate Finance & Taxation Committee; Do Not Pass 5-0.  This bill did not pass the Senate and is lost.

HB 1138:  A bill to provide an exemption from the state's fuel & excise taxes for fuel purchased by an emergency medical services operation.  Introduced by: Vigesaa; Co-Sponsored by: Drovdal, Haas, Metcalf, Uglem, Klein.  This bill, expected to pass the House and has been amended in the Senate to include Air Ambulances.  Passed House 94-0.  Passed Senate amended 44-1; returned to House.  Passed House 93-0.  Signed into law by the Governor.

HB 1160:  A bill to provide an exemption from the state motor vehicle excise tax for vehicles originally manufactured as ambulances and when purchased by an emergency medical services operation.  Introduced by: Uglem; Co-sponsored by Belter, DeKrey, Kerzman, Vigesaa, Mathern.  This bill was amended in the House to include the Emergency Declaration.  This bill, expected to pass the House and has been amended in the Senate to include Air Ambulances.  Passed House 92-1.  Passed Senate amended 43-1; returned to House.  Passed the House amended 91-0. Signed into law by the Governor on 4-19-07.  This new law becomes effective immediately.

HB 1161:  A bill which allows for licensing of ambulance service substations, increases the statutory definition of a "volunteer" EMT and physician from $2,400 to $10,000 annually, and clarifies the supervision of EMTs working in a hospital setting.  Introduced by Uglem; Co-sponsored by DeDrey, Froelich, Vigesaa, Bowman and Krauter.  Passed House 93-0.  Passed Senate 45-0.  Signed into law by the Governor.

HB 1162:  A bill which would have vested all ND counties with the responsibility of providing reasonable EMS to the residents of that county.  Also, this bill would have authorized the state health council to adopt rules which established what reasonable EMS is; taking into account minimum requirements and response time.  Introduced by Haas; Co-sponsored by D. Johnson, Monson, Schmidt, J. Lee and Warner.  This bill, now heavily amended by committee resulting from intense unsupportive lobbying by the Association of Counties, does not contain any of the bill's original language (a hog-house bill).  It does however, contain language appropriate to and for the benefit of EMS issues.  Passed House 87-5.  Passed Senate 46-0.  Signed into law by the Governor.

HB 1290:  A bill to authorize the DoH to contract for the study of the state's Trauma System and to provide an appropriation of $100,000.  Introduced by: Price; Co-sponsored by J. Lee.  Passed House 88-0.  Received a Do Not Pass recommendation in the Senate Appropriations committee.  Work is being done to resurrect this bill either by having the committee re-visit their action or by finding a majority of Senators on the floor vote. The bill has been re-referred to the Senate Appropriations Committee for further work (3/27).  Passed Senate amended 45-0; returned to House.  Passed both Chambers; Signed into law by the Governor.

HB 1296  A bill to amend NDCC related to the insurance premium tax and to provide an appropriation of $5.5M for emergency medical services operations.  Introduced by: Haas; Co-sponsored by Boe Vigesaa, Wald, Andrist, Warner.  This bill was amended in the House Appropriations Committee reducing the amount of appropriation to $1M.  It is expected to pass the House and we were successful in amending the bill up to $2M in the Senate.  Passed House 92-0.  Senate appropriations amended the bill down to $1.5M and recommended a Do Pass (14-0).  Passed Senate amended 42-0; returned to House.  Sent to Conference Committee and returned to both chambers with an appropriation of $1.25M.  Passed House 94-0; Passed Senate 47-0; Signed into law by the Governor.
